All words and expressions used and not defined in this document but defined in the Act or the Rules shall have the meanings respectively assigned to them in the Act or the Rules. Reference to “you” or “your” in this Privacy Policy refers to any natural person (including the employees of LCK) who provides to LCK any Personal Information (PI) or Sensitive Personal Data and Information (SPDI) or any user(s) of LCK’s website or business applications whether or not, you avail the Services offered by LCK.

 

“Users/Customers” mean and include persons registering/accessing, products and services displayed by LCK and includes Buyers and Sellers.

App” to mean and include our Application for mobile phones and hand held devices

Services” to mean and include services listed on the LCK’s website and App.

“We/us/our/ours” or any first-person reference throughout this Policy shall mean LCK.

“You/your” or any second-person reference throughout this Policy would mean you (the person using/visiting the Services).   

Expressions, unless otherwise stated in this Policy, shall bear the meanings those stated in the applicable governing laws.

“Act” shall mean the Information Technology Act, 2000 and Rules thereunder as amended from time to time.

“Information” shall mean and include Personal Information and Sensitive Personal Data and Information as may be collected by LCK.

“Personal Information (PI)” shall have the same meaning as under Rule 2 (i) of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 as amended from time to time and shall include any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

 “Rules” shall mean the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 as amended from time to time.

“Registered User” shall mean such user whose registration is accepted by LCK.

 “Sensitive Personal Data and Information (SPDI)” shall mean and include information under Rule 3 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 as amended from time to time. As per Rule 3 the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011, Sensitive Personal Data or Information of a person means such personal information which consists of information relating to:-

(i) password;

(ii) financial information such as Bank account or credit card or debit card or other payment instrument details;

(iii) physical, physiological and mental health condition;

(iv) sexual orientation;

(v) medical records and history;

(vi) Biometric information;

(vii) any detail relating to the above clauses as provided to body corporate for providing service; and

(viii) any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise: provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules.

“Services” for the purpose of this Privacy Policy shall mean any person who by way of registration has sought or in any manner has requested the services of LCK.

LCK is fully committed to respecting your privacy and shall ensure that your Information is safe. This privacy policy sets out the practices adopted in respect of Information, including the types of Information that is collected, how the Information is collected, how the Information is used, how long the Information is retained and with whom it is shared (“Privacy Policy”). This Privacy Policy is published in compliance with the provisions of the Act and the Rules made thereunder that require publishing the privacy policy on LCK’s website. The Users: visitors to our website and Application for handheld devices, User or Customer who avail services listed on our website. Our users can be from anywhere, all around the country.

Should you opt to access such services of LCK, which are available only to Registered Users, Information is required to be provided by you at registration such as your name, date of birth, address, email ID, gender and phone number. Providing additional information beyond what is required at the time of registration is entirely optional and can be altered or removed by you at any time. Registered Users are given access to the web portal/business applications based on the password based authentication which is chosen by them and securely stored in LCK’s servers for the purpose of authentication of the Registered Users at the time of login;
  2. Information that you provide directly to LCK via email or any other mode of electronic communication;
  • Information that you provide to LCK over telephone. LCK may make and keep a record of such information shared by you;
  1. Information that you provide to LCK in physical form whether sent through post or courier or handed over to a representative of LCK in person; and
  2. PI/SPDI collected by LCK from its employees, suppliers or onsite consultants for the purpose of employment, availing their services and recording their attendance etc.

 

  1. Who will have access to all the personal data/information?

The marketing and sales team of LCK as well as other personnel appointed by or on behalf of the LCK to access the information in order to offer you quality products/services but, based on a strict “need-to-know” basis, will have access to the personal data for the purposes of achieving the best deal for its members/users.

The administrative and/or technical staff who ensure the smooth running and operational support of our marketing tools and website may also have access to these data in virtue of the roles they are assigned in LCK. All our trained personnel, staff and other employees are subject to confidentiality clauses.

We may disclose Personal Information to any member of our group, which includes our subsidiaries, our ultimate holding company, and its subsidiaries, who support our processing of Personal Information.

 

Additionally, the Services also consist of third party software development toolkits (SDKs) which collect the personal information for the purpose of enhancing business of LCK, thereby providing quality Services to the users/subscribers. There are categories of SDKs based on the purpose of work. It is imperative to note that the third parties have independent privacy policies and they are governed as per the said policies. We disclose Personal Information to service providers who help us provide the Services to you, such as cloud providers and payment processors. We also disclose Personal Information to advertising partners and may disclose it to other business partners such as affiliates.

 

LCK has contracts with the third parties for securing the personal data of the users/subscribers. Besides, it is to be noted that in case of protecting the rights of the Users, protecting the rights of LCK or in the course of any legal intervention or legal compliance, LCK shall be bound to disclose the Personal Data as and when required by the respective authorities.

 

Merger sale, or other asset transfers. In connection with the consideration, negotiation, or completion of a corporate transaction in which we sell or transfer all or a portion of our business or assets, but only to the extent that your Personal Information is necessary for such transactions, in which case we will comply with applicable legal requirements when processing your Personal Information.

Due to any of the reasons stated here in the Privacy Policy or due to any legal proceedings or in the due course of complying with any laws applicable to the Privacy Policy, we may transfer the Personal Data to countries other than your residential country. LCK has its headquarters in India. Information we collect about you will be processed in India and depending upon the nature of your interaction with us, may be further processed in other countries. For example, if your goods are being shipped from a country other than where you are located, your Personal Information will be disclosed to a carrier in that country as part of our shipping process.

 

  1. What else do we collect apart from personal information?

We also collect the device information through which the user contacts us. The location information is used by us when the same is enabled from the user’s end. All the technical details pertaining to your membership are under our supervision which includes the user’s account information as well.

Purchase Information: When making a purchase via our Services, we collect your shipping address, payment information and billing address. Payment information is collected through a third-party payment gateway and we do not store payment card information. Depending on your jurisdiction, you may also need to provide additional information related to customs and taxes, for example a VAT ID.

Marketing information: When you sign up to receive SMS marketing messages from us, you provide us with your mobile phone number.

Seller Information: Sellers must provide payout information including date of birth, address, and bank account, bank card, or digital payment services account information (e.g., Paypal). This information is collected through a third-party payment gateway and we do not store payment card information. We may additionally require a government identification number (e.g. GST ID, VAT ID etc.) to satisfy tax or information reporting obligations.

Contests:  If you enter a contest sponsored by us, you may provide us with your name, date of birth, mailing address and e-mail address if you enter via postal mail. If you enter through a social media platform, you will provide your social media handle and potentially other Personal Information as part of your entry.

Surveys and reviews:  If you have chosen to receive marketing messages from us, we may contact you to participate in surveys about the Services or provide product or Services reviews. If you decide to participate, you may be asked to provide Personal Information.

  1. Is LCK using automated decision-making processes?

The automated decisions are defined as decisions on individuals which are taken only on basis of an automated processing of data and which produce legal effects on the individuals or affect them in a significant way. LCK does not take automated decisions as described above. The human resources at LCK collects the data online, processes it by using various data filer and accordingly, awards the requirements of the respective user.

 

  1. How is the payment made by its User/Customers?

Payment through Payment Gateway (eg. UPI, Credit/Debit card, Internet Banking etc.):

LCK in collaboration with the partner bank reduces the risk of fraudsters as the bank plays a role of a trusted third-party that collects, holds and only disburses funds when both the transacting parties to the business are satisfied. LCK, in these circumstances, verifies each angle of the transaction and then ultimately serves its user with best results.

 

  1. How long will the user’s data be stored?

We will retain Personal information for the period necessary to fulfil the purposes for which it was collected, as described in this Privacy Policy, unless a longer retention period is required by law. We delete your Personal Information or keep it in a form that does not identify you when this retention period is over.

When determining the retention period, we consider various criteria, such as the nature and length of our relationship with you, possible re-enrolment with our Services, the impact on our ability to provide you with certain features of our Services if we delete some information from or about you, and mandatory retention periods provided by law and the statute of limitations.

Additionally, we will keep the records for the duration of the contract between the Subscriber/User and LCK in the event the contract is terminated will discharge/delete your records in our database along with complying with the laws applicable at the time being. However, you may request us to remove your data earlier. In that case, we will remove all data we have subject to our internal policy and except the data we will legally have to maintain with us.

 

We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our Services. You cannot be identified from aggregate information retained or used for these purposes.

 

  1. How can the LCK terminate the User’s subscription or restrict User’s/Customers access?

LCK reserves the right to terminate your subscription and / or refuse to provide you with access to the products or Services if it is discovered that you are not an adult (i.e. below the age of eighteen (18) years) and the consent to use the products or Services is not made by your parent/legal guardian or any information provided by you is inaccurate. You acknowledge that LCK does not have the responsibility to ensure that you conform to the aforesaid eligibility criteria. It shall be your sole responsibility to ensure that you meet the required qualification. Any person under the age of 18 (eighteen) should seek the consent of their parents/legal guardians before providing any Information about themselves or their parents and other family members on the Application and shall use or access the information on the website or any portal related to the Services under the presence and guidance of an adult or the guardians. We do not support or knowingly encourage the use of the Services by any person below the age of eighteen years, without the presence of an adult or guardians.
